Individuals may gift adult-use cannabis to others but may not sell it without a cannabis license. The following examples are illegal and are not considered gifts:
- Cannabis given away at the same time as another transaction between the same parties
- Cannabis offered or advertised in conjunction with an offer for the sale of goods or services
- A gift of cannabis that is contingent upon a separate transaction for goods or services
- Cannabis is given away at a public social event by a business entity or in exchange for a monetary amount to enter an event. (Note: Onsite consumption and public social events where cannabis is distributed is not permitted.
Medical marijuana products may not be gifted to non-patients.
It will remain illegal to distribute or sell marijuana, and/or to possess any amount of cannabis with the intent to distribute or sell it. This prohibition applies equally to businesses, which will not be permitted to sell, gift, or in any other way distribute cannabis.
