The above-captioned matter was scheduled to be heard as a contested case on February 20, 2013 at 11:30 A.M., at which time the respondents appeared, but the complainant did not appear to prosecute the case.  On February 26, 2013, a report of hearing officer dated February 20, 2013 was sent to all parties.  However, by letter dated March 4, 2013, counsel for the complainant informed the Commission that the underlying issue was resolved to the complainant's satisfaction prior to the hearing in the above-captioned matter, through the Commission's ombudsman process.  The complainant therefore wished to withdraw the complaint without prejudice.

     The Commission takes administrative notice of the complainant’s withdrawal and recommends the following order on the basis of the record:

     1.  Based on the withdrawal of the complaint, the case is hereby dismissed.
