     The above captioned matter was heard as a contested matter on August 14, 1978 at which time the complainant and the respondents appeared and stipulated to certain facts.
     After consideration of the entire record, the following facts are found:
     1.  The respondents are public agencies as defined by §l-18a (a), G .S.
     2.  On May 15, 1978, the complainant requested from the respondents certain records kept by the respondents.
     3.  Having failed to receive a reply within four business days, the complainant filed the present appeal with the Commission on June 9, 1978.
     4.  The respondents promised to make the requested records available to the complainant on June 23, 1978 and again at hearing.
     5.  The records in question consist of the following:
a. a transcript of the respondent commission's November 14, 1974 public hearing,   consisting of some 57 pages;
b. a certain grant application consisting of some sixty pages, dated December 31, 1974,   relating to the Muddy River Interceptor;
c. six pages of minutes from the public hearing of the respondent commission, held on July 21, 1975, relating to proposed sewers for Patten Heights;
d. an extract from the minutes of the August 19, 1975 special town meeting of the respondent town, consisting of five pages.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:
     1.  The respondents shall forthwith make the records described in paragraph 5 of the findings above available to the complainant, as required by §l-19(a), G.S.
     2.  Although not a part of this case, it is to be noted that the co mplainant requested two additional records from the respondents for the first time at this hearing.  The respondents, in the same spirit of cooperation indicated above, have further promised to provide the complainant with access to these additional records.  Such cooperation between the parties should avoid the necessity of further hearings on this same or similar matters and should be congratulated.
