The above captioned matter was heard on May 9, 1978, at which time it was consolidated for hearing with Docket #FIC 78-54, Randall Meredith against Town of New Canaan; Chief of_ Police of the Town of New Canaan, and Police Commission of the Town of New Canaan. At such hearing, the complainant and the respondents appeared, stipulated to certain facts, and presented testimony, exhibits and argument on the complaint.
Upon motion duly made, Council 15 of the Police Unions American Federation of State, County and Municipal Employees, AFL-CIO, was granted the status of intervenor and permitted to examine witnesses and present oral and written argument.
After consideration of the entire record, the following facts are found:
1. The respondents are public agencies as defined by §1-18a(a), G.S.
2. By letter dated April 20, 1978, the complainant requested from the respondents a copy of the police manual, regulations, and/or instructions governing the activities and procedures of the members of the police department of the respondent town.
3. By letter dated April 21, 1978 and filed with the Commission on April 25, 1978, the complainant appealed to the Commission alleging that his request had been refused by the respondents and requesting a hearing by the Commission to determine his rights to such records.
4. All portions of the police manual sought by the complainant were made available by or at the time of hearing, to his full satisfaction.
The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:
1. The complaint is hereby dismissed.
