The above captioned matter was scheduled for hearing on May 16, 1978. At that time the complainant and the respondent appeared and presented argument.
After consideration of the entire record, the following facts are found:
1. The respondents are public agencies within the meaning of §1-18a(a), G.S.
2. By letter dated January 26, 1978, the complainant requested a copy of the dossier of Daniel Schaeffer, and made various requests for information of the respondent attorney general.
3. By letter dated January 31, 1978, the respondent stated that no dossier existed and provided certain other information to the complainant.
4. Subsequently, the complainant indicated to the respondent, by letter, that he believed his initial request had not been answered.
5. By letter dated February 27, 1978, the respondent indicated that no further information would be provided.
6. By letter filed with this Commission on April 27, 1978, the complainant appealed the respondent's refusal.
7. At hearing, the respondent filed a motion to dismiss, claiming, among other things, that the Commission lacked jurisdiction to hear the complaint because the complaint was not brought within the time limit provided in P.A. 77-609, Sec. 6(b).
8. Public Act 77-609, Sec 6(b) amends §1-21i, G.S., by providing that appeals to the Freedom of Information Commission must be brought within thirty days.
9. It is concluded that the complainant's appeal was not brought within the time limit of thirty days as provided in P.A. 77-609, Sec. 6(b).
The following order by the Commission is hereby recommended on the basis of the record and the finding concerning the above captioned complaint.
1. The complaint is hereby dismissed.
