Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Seven appellants were present, five appellants failed to appear. The State Issuing Authority and seven local Issuing Authorities were present and two failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. Cynthia Conrad, Carolyn Futtner, Esq., Anthony Iaconis, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, Chief Carl Rosensweig.

Board Members Absent: None

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Nineteen cases were heard in the following order:

1) Case No. 19-234-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Charles Miller represented the Local Issuing Authority, Chief Roberto Rosado, Willimantic Police Department.

Withdrawal: The appellant withdrew his case.

2) Case No. 18-248-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Rachel M. Baird, Esq.  Tpr. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew, agreement with state will reissue.

3) Case No. 18-008-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Tpr. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew, agreement with state will reissue.

4) Case No. 19-352-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Chief Marshall Porter appeared for the local Issuing Authority, Chief Marshall Porter, Glastonbury Police Department.

Decision: By majority, the Board voted in favor of the appellant. Chairman Blando, Dr. Conrad, Atty. Futtner, Atty. Iaconis and Mr. Kuck voted in favor of the appellant. Col. Overturf, Chief Carl Rosensweig and Ms. Johnson voted in favor of the Issuing Authority. Vote was 5-3 in favor of the appellant and ordered Glastonbury to issue the permit.

5) Case No. 19-323-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Chief Richard Brown was present for the local Issuing Authority, Chief Richard Brown, Suffield Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Suffield to issue the permit.

6) Case No. 19-236-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Chief Christopher Ferace was present for the local Issuing Authority, Chief Christopher Ferace, Putnam Police Department.

Withdrawal: The appellant withdrew her case.

7) Case No. 18-412-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Tpr. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

8) Case No. 19-471-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. No one appeared for the Local Issuing Authority, Chief William Fitzgerald, Winchester Police Department.

Motion: Board member Kuck made a motion for the appellant, by default, due to the Issuing Authority failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

9) Case No. 18-438-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Tpr. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

10) Case No. 18-452-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Tpr. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

11) Case No. 19-397-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  No one appeared for the local Issuing Authority, Chief Mark Rinaldo, Avon Police Department.

Withdrawal: The appellant withdrew his case, due to a disqualifier.

12) Case No. 18-406-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Tpr. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

13) Case No. 18-442-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Tpr. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case.

14) Case No. 18-454-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Chet Jackson, Esq.  Tpr. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case.

15) Case No. 19-469-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Jeff DePerry appeared for the Local Issuing Authority, Chief Michael Spera, Old Saybrook Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

16) Case No. 19-557-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.  Atty. Sean Diakun appeared for the Local Issuing Authority, Chief Christopher Chute, New Britain Police Department with one witness.

Decision: By majority, the Board voted in favor of the appellant. Chairman Blando and Ms. Johnson voted in favor of the Issuing Authority. Col. Overturf, Dr. Conrad, Atty. Futtner, Atty. Iaconis, Mr. Kuck, and Chief Carl Rosensweig voted in favor of the appellant. Vote was 6-2 in favor of the appellant and ordered New Britain to issue the permit.

17) Case No. 19-451-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Atty. Sean Diakun appeared for the Local Issuing Authority, Chief Christopher Chute, New Britain Police Department with one witness.

Decision: By majority, the Board voted in favor of the appellant. Chief Carl Rosensweig voted in favor of the Issuing Authority.  Chairman Blando, Secretary Col. Overturf, Dr. Conrad, Atty. Futtner, Atty. Iaconis, and Mr. Kuck, voted in favor of the appellant. Vote was 6-1 in favor of the appellant and ordered New Britain to issue the permit.

18) Case No. 19-384-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Sgt. Steven Penn appeared for the Local Issuing Authority, Chief Denise Lamontagne, Cromwell Police Department.

Decision: By majority, the Board voted in favor of the Issuing Authority. Chief Carl Rosensweig and Dr. Conrad voted in favor of the appellant. Chairman Blando, Secretary Col. Overturf, Atty. Futtner, Atty. Iaconis, and Mr. Kuck, voted in favor of the Issuing Authority. Vote was 5-2 in favor of the Issuing Authority.

19) Case No. 19-510-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.  Sgt. Ashley Taylor appeared for the Local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

 

Secretary’s Report:

Board member Atty. Futtner made a motion to accept the minutes from August 22, 2019, seconded by Chief Rosensweig, motion carried. Col. Overturf abstained.
