BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order
Chairman Frank P. Blando called the meeting to order at 10:00am.
Chairman Blando read the Introductory Statement and called the roll call. Eleven appellants were present, one appellant failed to appear, one case was continued and one case was issued by local issuing authority. The State Issuing Authority and nine local Issuing Authorities were present and two failed to appear.
Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner, Esq., Chief Carl Rosensweig, Gudrun Johnson, and Mr. M. Peter Kuck. Dr. William Sledge arrived during the roll call.
Board Members Absent: None
Chairman Frank P. Blando administered the oath to all witnesses.
Hearings: Twelve cases were heard in the following order:
1) Case No. 18-328-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Kenneth Keroack represented the local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.
2) Case No. 17-201-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James Rovella, Department of Emergency Services and Public Protection with one witness.
Motion: Chief Rosensweig made a motion for the State Issuing Authority, seconded by Ms. Johnson, motion passed unanimously.
3) Case No. 18-210-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Conrad Seifert, Esq. No one represented the local Issuing Authority, First Selectman, Noel Bishop, Town of Westbrook.
Motion: Secretary Col. Overturf made a motion for the appellant, by default, due to the Local Issuing Authority failing to appear. Motion was seconded by Mr. Kuck, motion passed unanimously.
4) Case No. 18-246-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. No one represented the local Issuing Authority, Town Manager, Andrew Tierney Town of Hebron.
Motion: Board member Kuck made a motion for the appellant, by default, due to the Local Issuing Authority failing to appear. Motion was seconded by Dr. Sledge, motion passed majority. Chief Rosensweig voted in favor of the Issuing Authority, for incomplete application.
5) Case No. 18-364-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Charles Miller represented the local Issuing Authority, Chief Roberto Rosado, Willimantic Police Department.
Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.
6) Case No. 18-360a-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Kenneth Keroack represented the local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Decision: By a unanimous decision, the Board voted for the appellant due to the lack of evidence.
7) Case No. 18-555-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Capt. Marschner was present for the local Issuing Authority, Chief Keith Mello, Milford Police Department with one witness.
Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit. Mr. Kuck abstained from the vote.
8) Case No. 18-359-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Assistant Counsel Joseph Skully was present for the local Issuing Authority, Chief James P. Wardwell, New Britain Police Department with one witness.
Decision: By a unanimous decision, the Board voted for the appellant.

9) Case No. 18-296-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.. Lt. Joseph LaRose appeared for the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.
Motion: Secretary Col. Overturf made a motion for the appellant, seconded by Mr. Kuck, motion passed unanimously.
10) Case No. 18-186-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.. Lt. Heather Desmond appeared for the local Issuing Authority, Chief William McKenna, Middletown Police Department with one witness.
Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.
11) Case No. 18-254-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. with 2 witness. Sgt. Martin Martinez appeared for the local Issuing Authority, First Selectman Art Shilosky, Town of Colchester.
Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.
12) Case No. 18-320-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Heather Desmond appeared for the local Issuing Authority, Chief William McKenna, Middletown Police Department.
Decision: By a unanimous decision, the Board voted for the appellant.
Secretary’s Report:
Board Secretary Col. Kyle Overturf made a motion to accept the minutes from December 6, 2018, seconded by Atty. Futtner, motion carried. Mr. Kuck abstained from the vote.
New Business: Board members were introduced to Office Assistant, Lori Beaudoin prior to Board hearing.
Adjournment: Board member Kuck made a motion to adjourn. Seconded by Col. Kyle Overturf motion carried. Meeting ended at 4:05pm.
