BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Nine appellants were present, three appellant failed to appear and one case was resolved the day before the hearing. The State Issuing Authority and seven local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Dr. William Sledge, and Mr. M. Peter Kuck.

Board Members Absent: Board member Gudrun Johnson

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Twelve cases were heard in the following order:

1) Case No. 17-521-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Thomas C. Simones, Esq. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

2) Case No. 18-030-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Off. Jessica Blank appeared for the Local Issuing Authority, Chief James L. Cetran, Wethersfield Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

3) Case No. 17-564-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Trp. Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

4) Case No. 17-611-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Weisgerber represented the Local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

5) Case No. 16-263-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Det. Salmeron represented the Local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Dr. Sledge, motion passed unanimously.

6) Case No. 17-425-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant represented himself. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered the State Issuing Authority to reissue the pistol permit. Chief Rosensweig and Col. Overturf voted against the appellant, Chairman Blando, Dr. Sledge, Atty. Futtner and Mr. Kuck voted in favor of the appellant.

7) Case No. 18-069-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. with four witnesses. Lt. Jeffery DePerry represented the Local Issuing Authority, Chief Michael Spera, Old Saybrook Police Department with three witnesses.

Decision: By a majority decision, the Board voted in favor of the Local Issuing Authority to uphold the denial of the pistol permit. Chief Rosensweig and Col. Overturf voted for the appellant, Chairman Blando, Dr. Sledge, Atty. Futtner and Mr. Kuck voted against the appellant.

8) Case No. 17-499-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant represented himself. Tpr. Doug Sauve’ represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

9) Case No. 17-770-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Richard O. LaBrecque, Esq.  Sgt. Monahan appeared for the Local Issuing Authority, Acting Chief Fernando Spagnolo, Waterbury Police Department.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered the Local Issuing Authority to issue the pistol permit. Chief Rosensweig voted against the appellant, Chairman Blando, Col. Overturf, Dr. Sledge, Atty. Futtner and Mr. Kuck voted in favor of the appellant.

10) Case No. 17-765-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Off. Shane Wityak appeared for the Local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

11) Case No. 17-738-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Off. McKeown appeared for the Local Issuing Authority, Chief Paul Melanson, Farmington Police Department.

Decision: By a majority decision, the Board voted in favor of the Local Issuing Authority to uphold the denial of the pistol permit. Chairman Blando and Board member Kuck voted in favor of the Appellant and Chief Rosensweig, Col. Overturf, Dr. Sledge and Atty. Futtner voted against the appellant.

12) Case No. 17-772-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Off. Leo Brace represented the Local Issuing Authority, Chief Jonathan Fontneau , Stamford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

Secretary’s Report:

Board Secretary Col. Overturf made a motion to approve the minutes of September 6, 2018 seconded by Mr. Kuck, motion carried. Chairman Blando abstained.
