BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order
Chairman Frank P. Blando called the meeting to order at 10:00am.
Chairman Blando read the Introductory Statement and called the roll call. Ten appellants were present, seven appellant failed to appear. The State Issuing Authority and fifteen local Issuing Authorities were present.
Board Members Present: Chairman Frank P. Blando, Esq., Carolyn Futtner Esq., Dr. William Sledge, Mr. M. Peter Kuck, Chief Carl Rosensweig and Gudrun Johnson.
Board Members Absent: Col. Kyle Overturf
Chairman Frank P. Blando administered the oath to all witnesses.
Hearings: Seventeen cases were heard in the following order:
1) Case No. 18-046-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Alaric Fox represented the local Issuing Authority, Chief Aleric Fox, Enfield Police Department with two witnesses.
Decision: By a majority decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit. Board member Kuck voted in favor of the appellant and Chairman Blando, Atty. Futtner, Chief Rosensweig, Dr. Sledge and Ms. Johnson voted in favor of the Issuing Authority.
2) Case No. 17-456-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.. Sgt. Kim Nikola represented the Local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.
Motion: Chief Rosensweig made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.
3) Case No. 18-076-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.. Lt. Paul Neves represented the Local Issuing Authority, Chief Scott Sansom, East Hartford Police Department.
Motion: Chief Rosensweig made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Dr. Sledge, motion passed unanimously.
4) Case No. 17-552-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Trp. Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.
Motion: Chief Rosensweig made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.
5) Case No. 17-673-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Trp. Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.
Motion: Chief Rosensweig made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.
6) Case No. 18-027-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The Chief failed to appear for the local Issuing Authority, Chief Jams L. Heavey, Greenwich Police Department.
Motion: Board member Kuck made a motion for the appellant, seconded by Dr. Sledge. After discussing this case Dr. Sledge withdrew his second.
Continuance: Chief Rosensweig made a motion to continue this case, seconded by Ms. Johnson. By a majority, the Board voted to continue the case until October 18, 2018 per the appellant’s choice. Vote passed 5-1 in favor of the continuance. Mr. Kuck abstained from the vote.
7) Case No. 18-459-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Off. Anthony Popolizio represented the Local Issuing Authority, Chief Thomas Wydra, Hamden Police Department.
Motion: Chief Rosensweig made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.
8) Case No. 17-029-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Ralph D. Sherman. Sgt. Francis Monahan appear for the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Motion: Board member Kuck made a motion for the Local Issuing Authority due to the appellant having a NICS hit, seconded by Chief Rosensweig, motion passed unanimously.
9) Case No. 17-657-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Krzanowski appeared for the local Issuing Authority, Chief Michael Maniago, Torrington Police Department.
Motion: Chief Rosensweig made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.
10) Case No. 18-002-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Off. Shane Wityak appeared for the local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.
Motion: Board member Kuck made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Dr. Sledge, motion passed unanimously.
11) Case No. 18-042-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Joe Skully appeared for the local Issuing Authority, Chief James Wardwell, New Britain Police Department with one witness.
Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.
12) Case No. 17-344-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Ralph D. Sherman. Det. Sgt. Panton appeared for the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.
Motion: Board member Kuck made a motion for the Local Issuing Authority seconded by Chief Rosensweig due to the appellant having a felony out of New York, motion passed unanimously.
13) Case No. 18-106-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Kim Nikola represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.
Withdraw: The appellant withdrew his case.
14) Case No. 17-686-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Francis Monahan appear for the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.
15) Case No. 17-137-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Ralph D. Sherman. Det. Sgt. Adam Marcus appear for the Local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.
Motion: Board member Kuck made a motion for the appellant due to dismissed case out of state. Motion was seconded by Chief Rosensweig, motion passed unanimously.
16) Case No. 18-050-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Angelo Stavrides appear for the Local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.
17) Case No. 17-628-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Off. Phillips appear for the Local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.
Decision: By a majority decision, the Board voted to uphold the decision of the local Issuing Authority due to the appellant not appealing within the statutory required rule of the 90 days. Chairman Blando and Dr. Sledge voted in favor of hearing the appellant due to a miscommunication with the Boards office. Atty. Futtner, Chief Rosensweig, Dr. Sledge and Ms. Johnson voted in favor of the Issuing Authority. Vote was 4-2 in favor of the Local Issuing Authority.
Secretary’s Report:
Board member Kuck made a motion to approve the minutes of September 20, 2018 seconded by Dr. Sledge, motion carried. Ms. Johnson abstained.
New Business: Motion made by Mr. Kuck to table the discussion of the backlog, seconded by Attorney Futtner, motion carried unanimously.
Adjournment: Board member Kuck made a motion to adjourn, seconded by Dr. Sledge, motion carried unanimously. Meeting ended at 1:45pm.
