BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order
Chairman Frank P. Blando called the meeting to order at 10:00am.
Chairman Blando read the Introductory Statement and called the roll call. Seven appellants were present, one appellant failed to appear and two cases were resolved the day before the hearing. The State Issuing Authority and six local Issuing Authorities were present.
Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. William Sledge, Carolyn Futtner, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig .
Board Members Absent: None
Chairman Frank P. Blando administered the oath to all witnesses.
Hearings: were heard in the following order:
1) Case No. 17-049-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Gutsfeld represented the local Issuing Authority, Chief Michael Custer, Rocky Hill Police Department.
Motion: Board Secretary Overturf made a motion to find for the local Issuing Authority due to the appellant failing appear, in addition to having an automatic disqualifier. Board Member Kuck seconded the motion, motion carried unanimously.
2) Case No. 17-403-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew his appeal.
3) Case No. 17-525-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Chief James Purcell represented the local Issuing Authority, Chief James Purcell, Brookfield Police Department.
Motion: Board Secretary Overturf made a motion to find for the Issuing Authority due to the appellant failing appear, in addition to having an automatic disqualifier. Board Member Johnson seconded the motion, motion carried unanimously.
4) Case No. 16-530-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. A representative failed to appear for the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.
Motion: Board Member Kuck made a motion to find for the Appellant due to the Issuing Authority failing appear. Dr. Sledge seconded the motion. Motion carried unanimously.
5.) Case No. 18-366-CD, involving the constructive denial of a temporary pistol permit to carry pistols and revolvers. The appellant did not appear as Sgt. Monahan appeared for the local Issuing Authority Acting Chief Fernando Spagnolo, Waterbury Police Department, and informed the Board of the issuance of the permit,
Issued: The permit was issued on 6/20/2018
6) Case No. 17-532-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative failed to appear for the local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.
Motion: Board Secretary Col. Overturf made a motion to find for the Appellant due to the Issuing Authority failing appear. Ms. Johnson seconded the motion. Motion carried unanimously..
7) Case No. 17-296-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Joseph Skelly represented the local Issuing Authority, Chief James Wardwell, New Britain Police Department with one witness.
Withdrawal: The appellant withdrew his appeal.
8) Case No. 17-099-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Sgt. Brian Eckblom represented the local Issuing Authority, Chief Timothy Edwards, South Windsor Police Department.
Decision: By a majority decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit. Chairman Blando, Secretary Col. Overturf, Board members Atty. Carolyn Futtner, Chief Carl Rosensweig, Ms. Gudrun Johnson and Dr. Sledge voted in favor and Mr. Peter Kuck abstained from the vote.
9) Case No. 17-227-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Monahan represented the local Issuing Authority, Acting Chief Fernando Spagnolo, Waterbury Police Department.
Motion: Board Secretary Overturf made a motion to find for the Issuing Authority due to the appellant failing appear. Board Member Kuck seconded the motion, motion carried unanimously.
10) Case No. 17-497-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Robert Strohl represented the local Issuing Authority, Chief Louis Fusaro, Groton Police Department.
Motion: Board Secretary Overturf made a motion to find for the Issuing Authority due to the appellant failing appear. Board Member Johnson seconded the motion, motion carried unanimously.
11) Case No. 17-676-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Cpt. Brian Wright represented the local Issuing Authority, Chief Peter Reichard, New London Police Department.
Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.
12) Case No. 18-069-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Lt. Jeffery DePerry represented the local Issuing Authority, Chief Michael Spera, Old Saybrook Police Department.
Continance: Case continued to September 20, 2018.

Board member Chief Rosensweig made a motion to accept the June 7, 2018 minutes as submitted, Ms. Johnson seconded the motion, motion carried. Col. Overturf and Atty. Futtner abstained
