BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Ten appellants were present, four appellants failed to appear. The State Issuing Authority and ten local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. William Sledge, Carolyn Futtner, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, and Chief Carl Rosensweig.

Board Members Absent: None

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Fourteen cases were heard in the following order:

1) Case No. 17-319-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Former Chief Thomas Davoren represented the Issuing Authority, Chief Sean Cox, East Hampton Police Department

Withdrawl: The appellant withdrew.

2) Case No. 17-344-D , involving denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph Sherman represented the appellant. Det. Michael Panton represented the Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Continued: Continued to July 12, 2018.

3) Case No. 17-535-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph Sherman represented the appellant. Sgt. Joe Peperni represented the Issuing Authority, Chief Patrick Daley, Norwich Police Department

Continued: Continued to July 12, 2018.

4) Case No. 17-449-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Michael Panton represented the Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Motion: Secretary Col. Kyle Overturf made a motion to find for the Issuing Authority due to the Appellant’s failure to appear, seconded by Board Member Johnson. Motion carried unanimously.

5) Case No. 17-415-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Francis Monahan represented the Issuing Authority, Chief Vernon Riddick, Waterbury Police Department.

Motion: Secretary Col. Kyle Overturf made a motion to find for the Issuing Authority due to the Appellant’s failure to appear, seconded by Board Member Kuck. Motion carried unanimously.

6) Case No. 17-311-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. A representative failed to appear for the Issuing Authority, Mayor Robert Chatfield, Prospect Town Hall.

Motion: Board Member Kuck made a motion to find for the Appellant due to the Issuing Authority failure to appear, seconded by Board Member Col. Overturf. After discussion a vote was taken. Board Members Johnson, Rosensweig, and Futtner opposed the motion. Board Members Overturf, Sledge, Kuck, and Blando favored the motion. Motion passed by majority vote in favor for the appellant.

7) Case No. 17-390-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Todd Segar represented the Issuing Authority, Acting Chief Dan Coppinger, West Hartford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision for the Issuing Authority the denial of the appellants pistol permit.

8) Case No. 17-453-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. A representative for the Issuing Authority, New Haven Police Chief Anthony Campbell failed to appear.

Motion: Board Member Kuck made a motion to find for the Appellant due to the Issuing Authority failure to appear, seconded by Board Member Sledge. Motion passed unanimously.

9) Case No. 17-509-SD, involving the state denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Col. Overturf made a motion in favor of the Issuing Authority due to the appellant’s failure to appear, seconded by Board Member Kuck. Motion carried unanimously.

10) Case No. 17-537-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora D. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Col. Overturf made a motion in favor of the Issuing Authority due to the appellant’s failure to appear, seconded by Board Member Kuck. Motion carried unanimously.

11) Case No. 17-197-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The Issuing Authority failed to appear on behalf of State Trooper Russell Cody.

Motion: Motion in favor of the Appellant due to the Issuing Authority’s failure to appear, made by Board Member Col. Overturf, seconded by Board Member Kuck. Motion carried unanimously.

12) Case No. 17-271-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Sgt. Brian Falkenstein represented the local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department.

Decision: By majority decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Michael Lombardo, the denial of the pistol permit. Secretary Overturf, Board member Kuck, and Chief Rosensweig voted in favor of the appellant. Chairman Blando, Atty. Futtner, Ms. Johnson, and Dr. Sledge voted against the appellant.

13) Case No. 17-396-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Ash represented the Local Issuing Authority, Chief Shawn Boyne, New Milford Police Department.

Withdraw: Appellant withdrew, New Milford Police will issue permit.

14) Case No. 18-357-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Jeff Marcel represented the Local Issuing Authority, Chief John Salvatore, Monroe Police Department.

Motion: Board Member Kuck made a motion in favor of the appellant because of lack of evidence, seconded by Board Member Johnson. Motion carried unanimously.

Secretary’s Report:

Board member Col. Overturf made a motion to accept the April 12, 2018 minutes as submitted, Chief Rosensweig seconded the motion, motion carried. Board member Johnson abstained.

Adjournment: Board member Kuck made a motion to adjourn,  Dr. Sledge seconded the motion, motion carried. Meeting ended at 12:00pm
